It is a distinctive symbol that a business uses to identify their products and/or services to set them apart from other companies. There are two types of "marks"” which are protected under trademark law.


1. A word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others.


2. A service mark is the same as a trademark, except that it identifies and distinguishes the source of a service rather than a product.


Examples include:

The Coca-Cola™ logo or the "Nike™” swoosh", with or without the term Nike.
